The EB-5 Investor Visa

The EB-5 Program is a foreign investor visa program that provides a permanent path into the United States. It is designed to stimulate the U.S. economy through job creation from foreign capital investment. Through the Program, EB-5 investors and their immediate family (spouse and unmarried children under the age of 21) may obtain Green Cards. A Green Card or permanent resident card allows you to live, study, work, and retire anywhere in the United States.

Direct EB-5 Investment Program

In 1990 Congress created the EB-5 Immigrant Investor Visa Program, also called the EB-5 Direct Investment Program. The Direct Investment Program is a permanent ongoing Program administered by U.S. Citizenship & Immigration Services (USCIS). The USCIS is accepting and processing EB-5 Visa petitions for both Direct Investment and Regional Center projects.

Regional Center Program

On March 15, 2022, President Biden signed the EB-5 Reform and Integrity Act as part of the Consolidated Appropriations Act, 2022 (Public Law 117-103), which created new requirements for the EB-5 immigrant visa category and the Regional Center Program. Immigrant visas are authorized under the Regional Center Program through Sept. 30, 2027.

Similarities

All EB-5 investors must make a capital investment in a new commercial enterprise that will create at least 10 full-time jobs for U.S. workers. The minimum qualifying investment is $1,050,000 and $800,000 USD if the investment is made in Targeted Employment Area (TEA) or infrastructure projects. Amounts increase with inflation every 5 years.

Differences

Job Creation Calculations. Direct EB-5 Investments must directly create10 jobs. The business invested in must employ 10 U.S. workers. There needs to be an employer-employee relationship between the company invested in and the jobs created. Investing through an EB-5 Regional center expands how the job creation requirement may be fulfilled, counting indirect and direct jobs.

Time and Type of Investment. When EB-5 applicants invest in the Direct Investment Program, they must commit more to the management of the new commercial enterprise than an applicant who invests through a Regional Center Program. For this reason, most EB-5 Direct investments are equity investments, and investments made through Regional Centers are typically debt/loan investments.
