The minimum EB-5 investment for a TEA or infrastructure project is currently $800,000. Starting 1 January 2027, it is scheduled to adjust for inflation and is projected to rise to approximately $937,500, with some estimates as high as $975,000. The final amount has not yet been officially announced.
We have been getting a lot of questions lately about what is actually changing with EB-5 at the end of this year. There are different numbers being discussed, three important dates approaching, and a lot of information to sort through. So, we thought it would be helpful to explain what we know today, what is still projected, and what prospective investors should be thinking about if they are considering EB-5 before the end of 2026.
There are three dates we want you to remember:
- November 30, 2026: New USCIS filing fees take effect.
- December 31, 2026: The final day to invest and file at today’s minimum amounts.
- January 1, 2027: The minimum EB-5 investment amounts are scheduled to adjust for inflation.
Before getting into those dates, let us first provide a brief overview of the EB-5 Program for those who may be exploring it for the first time.
What Is the EB-5 Program?
USCIS describes EB-5 as a program under which qualifying investors, along with their spouses and unmarried children under 21, may “apply for lawful permanent residence (become a Green Card holder)” by making the required investment in a U.S. commercial enterprise and meeting the program’s job-creation requirements.
For many of the families we speak with, this is what makes EB-5 so important. It is not simply about investing. It can provide an opportunity for the investor and their family to build their future in the United States as permanent residents.
Can EB-5 Investors Already in the U.S. File for a Green Card at the Same Time?
For certain EB-5 investors already living in the United States, there may be another important benefit to consider. USCIS states that an eligible investor may file an application to adjust status “concurrently with or subsequent to” Form I-526E when approval of the I-526E would make an immigrant visa immediately available.
In simple terms, qualifying investors may be able to file their I-485 Green Card application at the same time as their I-526E petition, rather than waiting for the I-526E to be approved first. As part of that process, they may also apply for employment authorization and a travel document while the Adjustment of Status application is pending. For families who qualify, the ability to pursue their Green Card application while also seeking authorization to work and travel can be an important benefit of the EB-5 process.
What Is Changing in the EB-5 Investment Amount in 2027?
Today, the minimum EB-5 investment is:
- $800,000 for an investment in a Targeted Employment Area (TEA) or qualifying infrastructure project.
- $1,050,000 for a standard EB-5 investment outside of those qualifying areas.
The EB-5 Reform and Integrity Act of 2022 established these amounts. The law also provided that the investment amounts would adjust for inflation beginning January 1, 2027, and every five years thereafter.
That means we know an adjustment is coming. What we don’t know yet is the final dollar amount the government will officially announce.
| Category | Current | Expected from 1 January 2027 |
| TEA/infrastructure | $800,000 | ~$937,500 (some estimates up to ~$975,000) |
| Standard (non-TEA) | $1,050,000 | ~$1,250,000 (IIUSA projection) |
Projected amounts. The final figures have not yet been officially announced.
How Is the New EB-5 Investment Amount Calculated?
This is one of those areas where EB-5 can quickly become more complicated than it needs to be. The law does not simply take $800,000 and add an inflation percentage to it. Instead, the inflation adjustment is made to the standard investment amount. The calculation works in three steps:
- The standard investment amount ($1,050,000) is adjusted for inflation.
- The adjusted standard amount is rounded down to the nearest $50,000.
- The TEA and infrastructure amount is then set at 75% of the adjusted standard amount. Only the standard amount is rounded; the TEA amount is not.
IIUSA (Invest in the USA), the national trade association for the EB-5 Regional Center Program, has analyzed the adjustment and projected:
- Standard investment: $1,250,000
- TEA/Infrastructure investment: $937,500
If $937,500 becomes the final TEA amount, an investor who can invest $800,000 today would need an additional $137,500 in investment capital once the new amount takes effect. There have also been projections showing the TEA amount could reach as high as $975,000, depending on the final inflation data used. At that level, the difference would be $175,000. We want to be very clear about this because it is important when discussing these upcoming changes with investors: The final 2027 investment amount has not yet been officially announced. The exact dollar amount is still projected. The January 1, 2027, inflation adjustment itself, however, is required under the law.
EB-5 Filing Fees Increase on 30 November 2026
This one is not a projection. New USCIS filing fees take effect November 30, 2026. For an investor filing Form I-526E through a Regional Center, the current USCIS filing fee is $3,675, plus the $1,000 Integrity Fund fee. Combined, that is currently $4,675.
Beginning November 30:
- I-526E filing fee: $7,850
- Integrity Fund fee: $1,100
- Combined: $8,950
That is an increase of $4,275 in these USCIS fees.
So, an investor looking at EB-5 before the end of this year is really looking at two separate cost changes.
Why Timing Matters for EB-5 Investors
One thing we want prospective investors to understand is that deciding to move forward and actually being ready to file are two different things. An important part of an EB-5 petition is documenting the investor’s lawful source and path of funds. This is where the immigration attorney documents where the $800,000 investment came from and how those funds moved from their source into the EB-5 investment.
Every investor’s situation is different. Documentation may involve employment or business income, bank records, property sales, investments, gifts, tax records, or a combination of different sources.
Gathering the right documentation can take time. There is also the investment itself to review. An investor needs time to understand the project, review the offering documents, work with immigration counsel, complete the investment documents, transfer the funds, and prepare the I-526E petition.
For that reason, we would not recommend that someone who is seriously considering EB-5 wait to begin the filing process. Preparing the source-of-funds documentation and completing all of the necessary steps can take time, and waiting could make it more difficult to file before the upcoming deadlines.
What Support Should EB-5 Investors Expect Throughout the Process?
There are a lot of moving pieces in an EB-5 investment. The investor is working with an immigration attorney, documenting the lawful source and path of funds, reviewing investment documents, transferring funds, and preparing for immigration milestones that continue long after the initial I-526E filing.
At International Creative Capital, we believe the Regional Center should remain an active part of that process.
We work directly with our investors and their families and take the time to understand their goals and what they hope to accomplish in the United States. We also coordinate closely with their immigration counsel so that the investment and immigration sides of the process continue moving together.
Our relationship with an investor does not end when the investment is funded or the I-526E petition is filed. We remain accessible and involved throughout the EB-5 process, including the later stages as our investors move toward removal of conditions and permanent residency.
That is an important part of how we operate at ICC. Our investors are families making a significant decision about their future, and we believe they should have a Regional Center that remains available to them throughout that journey.
What Should Investors Ask Before Choosing an EB-5 Project?
Upcoming deadlines are important, but they should not be the only reason an investor selects an EB-5 project. Understanding the underlying investment and where the project stands today is equally important.
Some practical questions we encourage prospective investors to ask are:
- Has the project already been built, or is construction still ahead?
- Is the business currently operating?
- Is it generating revenue?
- Has the required EB-5 job creation already occurred?
- What EB-5 immigration history does the project have?
Those are important considerations when comparing EB-5 opportunities.
The Canopy Hotel EB-5 Opportunity
At International Creative Capital, we currently have a limited number of investor positions remaining in the Canopy Hotel EB-5 opportunity at today’s $800,000 TEA investment level. The Canopy Hotel is a fully constructed, operating, and revenue-generating hotel. The project is not waiting for construction to begin, and the EB-5 job creation requirement has already been met.
The project also has an established EB-5 immigration history. ICC has achieved a 100% approval rate for adjudicated I-526 petitions associated with the Canopy Hotel EB-5 project, with I-829 petition approvals also achieved.
Source: International Creative Capital (ICC) internal investor records and USCIS approval notices. Supporting documentation, appropriately redacted to protect investor confidentiality, may be made available to qualified prospective investors upon request, subject to investor authorization.
In addition:
- EB-5 job creation requirements already met
- Completed, operational, and revenue-generating hotel
- Limited investor positions remaining before the offering closes
For us, these are important distinctions.
No EB-5 investment is without risk, and every investor should conduct their own review with their professional advisors. At the same time, we believe it is important for investors to understand the difference between evaluating a project that is already built and operating and one that still depends on future construction and operations.
Summary: Key Dates and Amounts
If you remember nothing else from this article, remember that today a qualifying TEA EB-5 investment is $800,000, and that these three dates matter:
- November 30, 2026: New USCIS EB-5 filing fees take effect, increasing the I-526E filing fee and Integrity Fund fee from a combined $4,675 to $8,950.
- December 31, 2026: The final day to invest and file at today’s minimum amount of $800,000.
- January 1, 2027: The new minimum investment amounts are scheduled to take effect, adjusted for inflation.
USCIS explains that beginning January 1, 2027, and every five years thereafter, the EB-5 investment amounts will automatically adjust for inflation. The exact 2027 investment amount has not yet been officially announced by USCIS. IIUSA’s current analysis projects a $937,500 TEA investment amount, although the final amount will depend on the inflation calculation required under the law.
What we already know is that the cost of EB-5 is changing, and investors considering filing before the end of the year should allow themselves enough time to properly prepare.
EB-5 Investment Amount 2027: Frequently Asked Questions
How much will the EB-5 minimum investment be in 2027?
The final 2027 amount has not yet been officially announced. IIUSA currently projects $937,500 for TEA and infrastructure investments and $1,250,000 for standard investments, and some projections show the TEA amount reaching as high as $975,000.
When will the EB-5 investment amount increase?
The investment amounts are scheduled to adjust for inflation on January 1, 2027. The adjustment is required under the EB-5 Reform and Integrity Act of 2022 and repeats every five years after that.
What is the difference between TEA and non-TEA investments?
Today, a qualifying investment in a Targeted Employment Area (TEA) or infrastructure project requires a minimum of $800,000. A standard investment outside those areas requires $1,050,000.
Why is the EB-5 investment amount increasing?
The EB-5 Reform and Integrity Act of 2022 requires the minimum investment amounts to adjust for inflation beginning January 1, 2027. The adjustment is made to the standard investment amount first, and the TEA amount is then set at 75% of the adjusted standard amount.
Will the TEA amount go above $1 million?
Based on current projections, No the TEA amount is not expected to go over $1 million. IIUSA projects $937,500, and the highest projection currently discussed is $975,000. The final amount depends on the inflation data used and has not yet been officially announced
Has the new EB-5 amount been officially announced?
No. USCIS has not yet announced the exact 2027 amounts, and the figures being discussed are projections. The January 1, 2027 inflation adjustment itself, however, is required under the law.
Will petitions filed before January 1, 2027 keep the current amount?
Yes. The investment amount that applies is determined by the date the I-526E petition is filed, so petitions filed before January 1, 2027 keep today’s amounts of $800,000 for TEA investments and $1,050,000 for standard investments. The new amounts apply to petitions filed on or after that date.
What is Form I-526E, and why does the filing date matter?
Form I-526E is the petition an investor files with USCIS when investing through a Regional Center. The filing date matters because it determines which USCIS fees apply, with new fees taking effect November 30, 2026, and which investment amount applies, with the adjustment scheduled for January 1, 2027.
How often does the EB-5 investment amount change?
The amounts adjust for inflation every five years. The first adjustment is scheduled for January 1, 2027, and the next would follow five years later.
What should investors consider when deciding when to file?
Investors should allow enough time to prepare, since documenting the lawful source and path of funds, reviewing the project and offering documents, working with immigration counsel, transferring funds, and preparing the I-526E can all take time. Two cost changes are coming: higher USCIS fees on November 30, 2026, and the new investment amount on January 1, 2027. For that reason, we encourage investors to start the conversation early.
